Contract for services
Photography Services Contract for VraneshPhoto llc. Revised 06/25/2026
This agreement is between __________________ (hereafter “the photographer” “photographer”) and __________________ (hereafter referred to as “CLIENT”).
1. Scope of Work: This contract is for services and products related to a photography shoot (hereafter “the shoot” or ‘the shoot”) to take place at the following time and place. PHOTOGRAPHER and CLIENT are to arrive for the SHOOT at _____________(time) and _________________(place). PHOTOGRAPHER agrees to provide no fewer than ________ photos for client to view after the shoot and is not required to provide more than this number of images. PHOTOGRAPHER will perform basic post-processing or digital image editing services on these photos where artistically necessary.
2. Fees: In consideration for the photography services provided by the PHOTOGRAPHER, CLIENT agrees to pay the sum of_________ . CLIENT agrees to pay the photographer a non-refundable initial payment totaling ____% of the total price of the photography services upon signing this contract. The initial payment reserves the photographer’s time and is not a retainer or a deposit. PHOTOGRAPHER agrees to not advertise availability of this time slot to any other potential clients. If CLIENT cancels this shoot for any reason, the initial payment will not be returned to CLIENT. The balance of the payment for photography services must be paid in full no later than 7 days after the SHOOT detailed in Section 1, Scope of Work.
3. Work Product: PHOTOGRAPHER will deliver proofs of photos to CLIENT no later than thirty days (30 days) after the date of the SHOOT. All digital files and photos delivered to CLIENT are licensed for CLIENT’S personal use only. Note that prints ordered through www.vraneshphoto.com are in addition to the digital proofs and files provided as part of the SHOOT unless prints and framing are ordered as part of a package.
4. Indemnification: 4.1 - PHOTOGRAPHER and CLIENT agree that PHOTOGRAPHER is under no obligation to capture any specific moment, or pose, or person(s) during the SHOOT. 4.2 – If PHOTOGRAPHER is unable to perform the services in this contract for any cause outside its control, client agrees to indemnify photographer for any damage, loss, liability; however, PHOTOGRAPHER will return in full all payments made by CLIENT to PHOTOGRAPHER in relation to this SHOOT. 4.3 – CLIENT agrees to indemnify and hold harmless PHOTOGRAPHER for any liability, damage, or loss related to technological failure, including data loss. 4.4 – CLIENT understands and agrees that PHOTOGRAPHER is not required to maintain copies of the photos from this shoot more than sixty (60) days after the photos have been delivered to client. 4.5 – CLIENT agrees to hold PHOTOGRAPHER harmless for any personal injury, which may occur as the CLIENT poses or works with PHOTOGRAPHER. 4.6 – PHOTOGRAPHER will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of CLIENT. Having said this, The PHOTOGRAPHER will work with the CLIENT before the SHOOT to determine what the CLIENT needs and wants and will strive to deliver photos that meet those expectations. 4.7 Last minute requests / the annoying, overbearing busybody clause: The PHOTOGRAPHER is happy to entertain suggestions about poses, lighting, location and other details but these are best discussed well before the SHOOT so that they can be planned for and scheduled in the SHOOT. There will be occasions on location when ideas come up and the PHOTOGRAPHER will be as accommodating as possible in light of time restrictions, movement of equipment, the weather and other factors. There is a difference between asking and demanding. Demands by the CLIENT or other associated parties, I.E. mothers of the bride, parents, coaches, friends of the CLIENT and others that the PHOTOGRAPHER use specific equipment, shoot specific poses, move to other locations and etc. which were not part of the original negotiations and contract terms are not binding on the PHOTOGRAPHER. Again, if ideas come up during a SHOOT, the PHOTOGRAPHER will be as accommodating as possible considering the other constraints of the SHOOT and the terms of the contract. Anyone who is not a signatory on the contract has no say in the SHOOT or the results. The secret is that ideas presented in a personable and reasonable fashion are likely to be considered where DEMANDS that things be done in a certain way regardless of contract terms, will be ignored.
5. Duty of Client: CLIENT is obligated obtain all permissions necessary for PHOTOGRAPHER to photograph at the SHOOT. PHOTOGRAPHER has no duty to obtain permissions at reception centers, churches, buildings, properties, or other locations to operate thereon. CLIENT agrees that any failure to obtain these permissions resulting in fines to photographer, or which prevent the photographer from photographing the event(s), is not the fault, liability, or responsibility of photographer. Note that permissions to shoot in specific locations, buildings and parks can take time to get. Often you are dealing with government entities and other organizations and are at the mercy of their systems and processes. Two months lead time is not unreasonable in the quest for location permissions so plan ahead. Also, the owners / managers / caretakers of many churches, hotels, public buildings and other spaces may not allow flash photography or supplemental lighting setups in the structures. This can end up in certain results being impossible to attain with natural light. Other restrictions may apply such as time of day, specific rooms or spaces, insurance requirements and more. Please check and relay information to PHOTOGRAPHER.
6. Exclusive Photographer: CLIENT agrees and understands that no other party other than PHOTOGRAPHER may take pictures of any poses, lighting situations, or set-ups made by the photographer. This slows the photographer’s work and violates the photographer’s right to take pictures at the event(s).
7. Model Release: CLIENT grants permission to PHOTOGRAPHER and its assigns, licensees, and sublicensees permission to use CLIENT’S image, or likeness in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses. Therefore, PHOTOGRAPHER may use CLIENT’S likeness and image on PHOTOGRAPHER’S website, or other advertising. Note that in the case where multiple people are at an event, this release covers all subjects in the photos including but not limited to: teams, coaches, fans, families, event staff and others. Note that if certain individuals have legitimate security reasons to not have photos published or in the cases of organization policy, (such as A.A., Al Anon or others) the PHOTOGRAPHER will honor those requests and not utilize those photos in VraneshPhoto llc media, website and promotional work but can’t guarantee that specific individuals are not photographed during the event. NOTE THAT an additional model release may be required for use in situations where the photo will be published on line or in print or for use in contests. Other situations exist where additional release forms will be required also. PHOTOGRAPHER will outline this as necessary.
8. The PHOTOGRAPHER reserves the right to utilize assistants before, during and after the SHOOT. Cost for needed assistants will be disclosed during contract discussions and factored in to the final price. The need for assistants will be determined on a case by case basis and will take into account location details such as stairs, trails, the equipment necessary to obtain the expected results, setup time and other things.
